1. Scope and application

These Terms & Conditions apply to:

  • Use of the website hernextposition.com

  • Purchase of digital courses (Her Wealth Position, Her Career Playbook)

  • Purchase of strategic decision support services (Decision Brief, Decision Partnership, Intensive Sprint, 90-Day Intensive)

  • Participation in AI-powered intake questionnaires

  • Receipt of strategic reviews and related materials

They form a legally binding agreement between you and Octopus Tech GmbH.

2. Nature of services

Her Next Position provides:

  • Strategic decision support services

  • Digital educational courses and content

  • AI-powered structured intake questionnaires

  • Written strategic reviews and voice memos from Lisa Mayer

All services are educational and strategic in nature.

They do not constitute:

  • Financial advice or investment recommendations

  • Tax advice or accounting services

  • Legal advice or counsel

  • Medical or mental health advice

  • Coaching, therapy, or counselling

  • Employment guarantees or outcome promises

You remain fully responsible for your decisions and actions. Strategic reviews provide perspective and judgment based on patterns and experience, but final decisions are always yours.

3. Digital courses

When you purchase a digital course (Her Wealth Position, Her Career Playbook):

Access:

  • Access is granted immediately or within 24 hours of purchase

  • Access is personal and non-transferable

  • You may not share login credentials or course materials with others

License:

  • You receive a limited, non-exclusive, non-transferable license to access course materials for personal use only

  • Materials may not be shared, reproduced, distributed, or resold

  • You may not use course content for commercial purposes without written permission

Duration:

  • Unless otherwise stated, course access is provided for lifetime access OR six (6) months from the date of purchase (specify based on your business model)

  • If access is time-limited, it expires automatically at the end of this period

  • Extensions may be purchased separately if available

4. Strategic decision support services

4.1 Service structure

All strategic decision support services follow this process:

Step 1: Payment

  • Payment must be completed before intake begins

  • Payment is processed securely via Stripe

Step 2: AI-powered intake

  • You complete a structured questionnaire with an AI assistant (15-20 questions, approximately 20-25 minutes)

  • Your responses are organized into a summary for your review

  • You confirm the summary or request corrections

Step 3: Strategic review delivery

  • Lisa Mayer reviews your intake personally

  • You receive a written strategic review (2-3 pages) and voice memo

  • Delivery timelines vary by service tier (see Section 4.2)

Step 4: Follow-up access (varies by tier)

  • AI access for continued exploration (where included)

  • Monthly reviews or check-ins (Partnership, Sprint, 90-Day tiers)

4.2 Service tiers and delivery timelines

Decision Brief

  • Scope: One clearly defined decision

  • Delivery: 48-72 hours from intake completion

  • Includes: Written review (2-3 pages) + voice memo (5-10 min) + 2 weeks AI access

  • One-time engagement

Decision Partnership

  • Scope: Multiple decisions over time

  • Delivery: Monthly strategic reviews (48-72 hours each)

  • Includes: Unlimited AI access, 2 deep-dive reviews per month available, 48-hour response time

  • Billing structure: Month 1 trial (cancel anytime), Months 2-3 commitment, Month 4+ month-to-month

  • Cancellation: Can cancel after Month 1 or after Month 3; no refunds for current billing period

Intensive Sprint

  • Scope: Urgent high-stakes situation (30 days)

  • Delivery: Initial review within 24 hours (next business day), mid-month review, final review

  • Includes: 45-minute strategy call available (optional), 24-36 hour priority response

  • Fixed 30-day engagement, non-cancellable once started

90-Day Intensive

  • Scope: Major career transition (90 days)

  • Delivery: Initial assessment within 24 hours (next business day), 6 bi-weekly reviews

  • Includes: 60-minute initial call + 3 monthly calls available (optional), 24-36 hour priority response

  • Fixed 90-day engagement paid upfront, non-cancellable once started

4.3 Service conditions

Strategic reviews are provided:

  • Based on the information you submit during intake

  • Within the scope and format described at purchase

  • Using the HNP Strategic Decision Framework

  • At Lisa Mayer's professional judgment

We do not guarantee:

  • Specific outcomes or results

  • That you will agree with recommendations

  • That following recommendations will produce desired results

  • Employment, promotion, or compensation outcomes

You acknowledge:

  • Strategic reviews are opinion and judgment, not guarantees

  • You are responsible for verifying all information and making your own decisions

  • Lisa Mayer has no obligation to ongoing availability beyond the purchased service scope

4.4 Upgrades during intake

If complexity is detected during your intake, the AI assistant may offer an upgrade to a higher service tier (e.g., Brief → Partnership, Partnership → Sprint).

Upgrade process:

  • You will be notified of the upgrade recommendation and reason

  • You can accept the upgrade or continue with your original tier

  • If you accept, you will receive a payment link for the tier difference

  • Your strategic review will be delivered after upgrade payment is confirmed

Upgrade payments are non-refundable once the higher-tier service has been delivered.

5. Pricing and payment

All prices are displayed in CHF, USD, EUR, and GBP.

  • Prices shown at time of purchase apply to that transaction

  • We reserve the right to update prices at any time for future purchases

  • Price changes do not affect purchases already completed

Payment processing:

  • All payments are processed securely via Stripe

  • You must provide accurate billing information

  • Payment is due in full at the time of purchase (except monthly recurring services)

Recurring billing (Decision Partnership, if not upgraded):

  • Partnership is billed monthly after initial payment

  • Billing occurs automatically on the same day each month

  • You can cancel recurring billing at any time (takes effect at end of current billing period)

Failed payments:

  • If a recurring payment fails, access to services may be suspended

  • We will attempt to contact you to resolve payment issues

  • Access will be restored once payment is completed

6. Refund policy

6.1 Digital courses

Due to the digital nature of our courses, all sales of digital courses (Her Wealth Position, Her Career Playbook) are final.

No refunds, exchanges, or cancellations are offered once:

  • Access has been granted

  • Course content has been accessed or downloaded

  • Login credentials have been provided

By completing a purchase, you acknowledge and accept this policy.

6.2 Strategic decision support services

Decision Brief:

  • No refunds once intake has been completed and submitted to Lisa for review

  • If you cancel before completing intake, full refund available

  • If you complete intake but are dissatisfied with review quality, contact us to discuss (refunds at our discretion)

Decision Partnership:

  • Month 1: Cancel anytime before Month 2 billing for no further charges

  • Months 2-3: Commitment period, no refunds for current or remaining months in commitment

  • Month 4+: Cancel anytime, takes effect at end of current billing period

  • No refunds for partial months or months already paid

Intensive Sprint:

  • Non-refundable once intake has been completed and initial review delivered

  • Fixed 30-day engagement with defined deliverables

  • Cancellation not available once engagement has started

90-Day Intensive:

  • Non-refundable once intake has been completed and initial assessment delivered

  • Fixed 90-day engagement paid upfront

  • Cancellation not available once engagement has started

6.3 Exceptional circumstances

In exceptional circumstances (e.g., service not delivered due to our error, technical failure preventing access), we may offer:

  • Service re-delivery

  • Credit toward future services

  • Refund at our sole discretion

Dissatisfaction with recommendations or disagreement with strategic judgment is not grounds for refund.

7. Intake data and confidentiality

7.1 Information you provide

During the AI-powered intake process, you will be asked to share:

  • Professional background and career situation

  • Details about decisions you're facing

  • Organizational dynamics and relationships

  • Financial readiness and personal constraints

This information is used solely to provide strategic review services.

7.2 Confidentiality

We treat your intake data as confidential and will not:

  • Share your personal information with third parties (except service providers necessary to deliver services - see Privacy Policy)

  • Use your information for purposes other than providing services

  • Disclose your identity in case studies or examples without your explicit written consent

Anonymized insights from client situations may be used for educational content, but all identifying information will be removed.

7.3 Data retention

Intake data is retained as described in our Privacy Policy (Section 6).

You can request deletion of your intake data at any time, subject to legal retention requirements for payment records.

How it works:

  • The AI assistant asks structured questions to gather information

  • Your responses are processed to generate summaries

  • Summaries are reviewed by you before being sent to Lisa

  • Lisa provides all strategic judgment personally (AI does not make decisions about you)

AI limitations:

  • The AI assistant is a tool for information gathering, not strategic judgment

  • AI responses during intake are designed to facilitate the process, not provide advice

  • All strategic recommendations come from Lisa Mayer personally

Data processing:

  • Your intake data is processed by OpenAI's API

  • OpenAI does not use API data to train their models (per OpenAI API Terms)

  • See Privacy Policy for full details on data processing

10. Website use and availability

10.1 Availability

We aim to keep the website available and functional but do not guarantee:

  • Uninterrupted access

  • Error-free operation

  • Availability of specific features at all times

  • Compatibility with all devices or browsers

We may:

  • Update, modify, or remove website features at any time

  • Perform maintenance that temporarily limits access

  • Discontinue services with reasonable notice

10.2 Account security

If you create an account or receive login credentials:

These Terms & Conditions are governed by Swiss law.

Exclusive jurisdiction lies with the courts of Zürich, Switzerland, unless mandatory consumer protection laws provide otherwise.

If you are a consumer resident in the EU, you may also have rights under EU consumer protection regulations.
